What is Spousal Support?
Spousal support, also known as spousal maintenance or alimony, is a legal obligation that arises during or after a divorce, where one spouse is required to provide financial assistance to the other.
In Washington State, the court takes into consideration various factors when determining the necessity and amount of support. These factors include the following: 1) the financial resources of the party seeking maintenance; 2) the time needed to acquire education necessary to obtain employment; 3) the standard of living during the marriage; 4) the duration of the marriage; 5) the age, physical and emotional condition, and financial obligations of the spouse seeking maintenance; and 6) the ability of the spouse from whom maintenance is sought to meet his or her needs and obligations while providing the other spouse with maintenance.
By carefully examining these aspects, the court ensures a fair and equitable resolution that takes into account the unique circumstances of the individuals involved. In Washington State, these rules are based on RCW 26.09.090, which ensures fair and considerate decisions by the judges.
